Terms & Conditions


    The services that Barkal Technology provides to User is subject to the following Terms of Use ("TOU"). Barkal Technology reserves the right to update the TOU at any time without notice to User. The most current version of the Barkal Technology can be reviewed by clicking on the "Terms of Use" hypertext link located at the bottom of our Web pages.

    1. This Agreement, which incorporates by reference other provisions applicable to use of instafly.me, including, but not limited to, supplemental terms and conditions set forth hereof ("Supplemental Terms") governing the use of certain specific material contained instafly.me sets forth the terms and conditions that apply to use of instafly.me by User. By using Barkal Technology (other than to read this Agreement for the first time), User agrees to comply with all of the terms and conditions hereof. The right to use instafly.me is personal to User and is not transferable to any other person or entity. User is responsible for all use of User's Account (under any screen name or password) and for ensuring that all use of User's Account complies fully with the provisions of this Agreement. User shall be responsible for protecting the confidentiality of User's password(s), if any.


  2. Barkal Technology shall have the right at any time to change or discontinue any aspect or feature of instafly.me or the instafly API including, but not limited to, content, hours of availability, and equipment or tools needed for access or use. Instafly.me and the instafly API are undergoing active development and are subject to change. There are no guarantees of API backward compatibility.


    Barkal Technology shall have the right at any time to change or modify the terms and conditions applicable to User's use of instafly.me, or any part thereof, or to impose new conditions, including, but not limited to, adding fees and charges for use. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting on instafly.me, or by electronic or conventional mail, or by any other means by which User obtains notice thereof. Any use of instafly.me or instafly API by User after such notice shall be deemed to constitute acceptance by User of such changes, modifications or additions.


    Barkal Technology provides API subscriptions under monthly payments and reduced limit free trial for one month.The API subscription contains aviation data including that of landmarks, airports, flights and hotels.


    1. Accepting the Terms

      You may not use the APIs and may not accept the Terms if (a) you are not of legal age to form a binding contract with Barkal Technology, or (b) you are a person barred from using or receiving the APIs under the applicable laws of the Canada or other countries including the country in which you are resident or from which you use the Database and APIs.

    2. Entity-Level Acceptance

      If you are using the APIs on behalf of an entity, you represent and warrant that you have authority to bind that entity to the Terms and by accepting the Terms, you are doing so on behalf of that entity (and all references to “you” in the Terms refer to that entity).

    3. Registration

      In order to access certain APIs you may be required to provide certain information (such as identification or contact details) as part of the registration process for our third API gateway provider, RapidAPI, the APIs, or as part of your continued use of the Database and APIs. Any registration information you give to Barkal Technology will always be accurate and up to date and you’ll inform us promptly of any updates.

    4. Subsidiaries and Affiliates

      Barkal Technolgy has subsidiaries and affiliated legal entities around the world. These companies may provide the APIs to you on behalf of Barkal Technology and the Terms will also govern your relationship with these companies.


    User must complete the registration process by providing our third API gateway provider, RapidAPI with current, complete and accurate information as prompted by the application. User also will choose a password and a user name. User is entirely responsible for maintaining the confidentiality of User’s password and account. Furthermore, User is entirely responsible for any and all activities that occur under User’s account. User agrees to notify Barkal Technology immediately of any unauthorized use of User’s account or any other breach of security. Barkal Technolgy will not be liable for any loss that User may incur as a result of someone else using User’s password or account, either with or without User’s knowledge. However, User could be held liable for losses incurred by Barkal Technology or another party due to someone else using User’s account or password. User may not use anyone else's account at any time, without the permission of the account holder.


    1. Your End Users

      You will require your end users to comply with (and not knowingly enable them to violate) applicable law, regulation, and the Terms.

    2. Compliance with Law and Third-Party Rights

      You will comply with all applicable law, regulation, and third-party rights (including without limitation laws regarding the import or export of data or software, privacy, and local laws). You will not use the Database and APIs to encourage or promote illegal activity or violation of third-party rights.

    3. Permitted Access

      You will only access (or attempt to access) an API by the means described in the documentation of that API. (when available)

    4. API Limitations

      Barkal Technology sets and enforces limits on your use of the APIs (e.g. limiting the number of API requests that you may make or the number of users you may serve), in our sole discretion. You agree to, and will not attempt to circumvent such limitations. If you would like to use any API beyond these limits, you must obtain Barkal Technology’s express consent (and Barkal Technology may decline such request or condition acceptance on your agreement to additional terms and/or charges for that use). To seek such approval, contact the relevant Barkal Technology team for information.

    5. Communication with Barkal Technology

      We may send you certain communications in connection with your use of the Database and APIs.

    6. Feedback

      If you provide feedback or suggestions about our APIs, then we (and those we allow) may use such information without obligation to you.

    7. Non-Exclusivity

      The Terms are non-exclusive. You acknowledge that Barkal Technology may develop products or services that may compete with the Clients or any other products or services.


    1. API Clients and Monitoring

      The APIs are designed to help you enhance your websites and applications (“API Client(s)”). YOU AGREE THAT BARKAL TECHNOLGY MAY MONITOR USE OF THE APIS TO ENSURE QUALITY, IMPROVE BARKAL TECHNOLOGY SERVICES, AND VERIFY YOUR COMPLIANCE WITH THE TERMS. Barkal Technology may suspend access to the APIs by you or your API Client without notice if we reasonably believe that you are in violation of the Terms.

    2. Ownership

      Barkal Technology does not acquire ownership of your API Clients, and by using our APIs, you do not acquire ownership of any rights in our APIs or the content that is accessed through our APIs.


    1. API Prohibitions

      When using the APIs, you may not (or allow those acting on your behalf to):
      Sublicense an API for use by a third party. Consequently, you will not create an API Client that functions substantially the same as the APIs and offer it for use by third parties. Interfere with or disrupt the APIs or the servers or networks providing the APIs.
      Reverse engineer or attempt to extract the source code from any API or any related software, except to the extent that this restriction is expressly prohibited by applicable law. Use the APIs for any activities where the use or failure of the APIs could lead to death, personal injury, or environmental damage.

    2. Confidential Matters

      Developer credentials (such as passwords, keys, and client IDs) are intended to be used by you and identify your Database or API Client. You will keep your credentials confidential and make reasonable efforts to prevent and discourage other API Clients from using your credentials.


    1. Content Accessible Through our APIs

      Content accessible through our APIs may sometimes be subject to intellectual property rights, and, if so, you may not use it unless you are licensed to do so by the owner of that content or are otherwise permitted by law. Your access to the content provided by the API may be restricted, limited, or filtered in accordance with applicable law, regulation, and policy.

    2. Data Portability

      Barkal Technology supports data portability. For as long as you use or store any user data that you obtained through the APIs, you agree to enable your users to export their equivalent data to other services or applications of their choice in a way that’s substantially as fast and easy as exporting such data from Barkal Technology products and services, subject to applicable laws, and you agree that you will not make that data available to third parties who do not also abide by this obligation.

    3. Prohibitions on Content

      Unless expressly permitted by the content owner or by applicable law, you will not, and will not permit your end users or others acting on your behalf to, do the following with content returned from the APIs:

      Scrape, build databases, or otherwise create permanent copies of such content;

      Copy, translate, modify, create a derivative work of, sell, lease, lend, convey, distribute, publicly display, or sublicense to any third party;

      Misrepresent the source or ownership; or

      Remove, obscure, or alter any copyright, trademark, or other proprietary rights notices; or falsify or delete any author attributions, legal notices, or other labels of the origin or source of material.

    4. Quality of the data returned by instafly API and expectations

      The technologies used to provide the data is still in beta testing phase, this means that you accept that the returned data is never guranteed to be exauhstive conclusive or accurate. You also acceot that depending on the input there could be no returned data.


    1. Brand Features

      “Brand Features” is defined as the trade names, trademarks, service marks, logos, domain names, and other distinctive brand features of each party. Except where expressly stated, the Terms do not grant either party any right, title, or interest in or to the other party’s Brand Features.

    2. Attribution

      You agree to display any attribution(s) required by Barkal Technology as described in the documentation for the API (when it applies). Barkal Technology hereby grants to you a nontransferable, non-sublicensable, nonexclusive license while the Terms are in effect to display Barkal Technology’s Brand Features for the purpose of promoting or advertising that you use the Database or APIs. You must only use the Barkal Technology Brand Features in accordance with the Terms and for the purpose of fulfilling your obligations under this Section. In using Barkal Technology’s Brand Features, you must follow the Barkal Technology Brand Features Use Guidelines. You understand and agree that Barkal Technology has the sole discretion to determine whether your attribution(s) and use of Barkal Technology’s Brand Features are in accordance with the above requirements and guidelines.

    3. Publicity

      You will not make any statement regarding your use of a API which suggests a partnership with, sponsorship by, or endorsement by Barkal Technology without Barkal Technology’s prior written approval.

    4. Promotional and Marketing Use

      In the course of promoting, marketing, or demonstrating the APIs you are using and the associated Barkal Technology products, Barkal Technology may produce and distribute incidental depictions, including screenshots, video, or other content from your API Client, and may use your company or product name. You grant us all necessary rights for the above purposes.


    Subscription Fees
    All payments, subscriptions and refunds are handled by our third API gateway provider, RapidAPI, please email your request to support@rapidapi.comThe account of the credit card holder will automatically be charged by RapidAPI on the transaction date of the original subscription payment on each of the following months until cancellation. Discounts, special offers or rebates apply only for the valid term and apply to the full subscription rates. The full rate will apply after the first discounted month.

    If we are unable to renew the subscription because of inaccurate or outdated credit card information, Barkal Technology may terminate the subscription and these terms.

    The right to have access to our services under these terms is only effective upon payment of the subscription fees.

    In case that the subscription fees need to be raised for subsequent subscription periods, Barkal Technology provides a notice at least thirty (30) calendar days prior to the expiration of the current subscription you hold.

    Trial and free trial apply only to the first month after which the full rate applies.

    If you exceed the number of calls allowed for your paid or free plan, you will incur overage charges, please refer to your subscription plan page for details.


    Cancellation must be requested at minimum 10 days prior to the following renewal date.

    You can cancel your subscription from your RapidAPI account

    Requests to cancel by email or phone are not considered and do not accomplish cancellation.

    Your access to our API will continue through the end of your current paid period. For example, If your credit card is charged on the 19th of June and you cancel on June 27th, you will not lose access until 17th of July.

  14. Refunds

    Subscription fees and individual purchases are non-refundable.
